Terms of Service

1. ACCEPTANCE OF TERMS

By accessing or using the VAR PowerHub Campaign Platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not register or use the Platform.

These Terms apply to all users of the Platform, including supporters, volunteers, county coordinators, campaign executives, and administrators.

2. ELIGIBILITY

• You must be at least 18 years of age to register on the Platform
• You must be a Kenyan citizen or legal resident
• You must possess a valid National ID number
• You must support the Visionary Alliance For Ruto campaign
• You must provide accurate and complete registration information

3. USER ACCOUNTS

3.1 Account Registration

When you register, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

• You are solely responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized account access
• We recommend enabling two-factor authentication for enhanced security
• Do not share your password with anyone

3.3 Account Types

• Supporter: Basic access to campaign features and updates
• Volunteer: Ability to complete tasks and participate in rallies
• County Coordinator: Manage supporters within their assigned county
• Campaign Executive: Access to national analytics and intelligence

4. ACCEPTABLE USE POLICY

4.1 Prohibited Activities

You agree NOT to:

• Use the Platform for any illegal purpose or in violation of Kenyan law
• Harass, abuse, or threaten other users or campaign personnel
• Impersonate any person or entity or falsely state your affiliation
• Post or transmit malicious content, including viruses or malware
• Attempt to gain unauthorized access to other accounts or systems
• Use automated scripts or bots to interact with the Platform
• Share login credentials or sell your account to others
• Misrepresent campaign information or spread disinformation
• Use the Platform to spam or send unsolicited messages
• Attempt to manipulate supporter counts, donations, or task completions

4.2 Content Standards

When submitting content (stories, photos, videos, comments), you agree that your content will not:

• Contain defamatory, obscene, or hateful material
• Infringe on intellectual property rights of others
• Reveal sensitive personal information about others
• Contain false or misleading information

5. CAMPAIGN ACTIVITIES

5.1 Volunteering

• Volunteer tasks are assigned based on your county and availability
• Completion of tasks must be truthful and verifiable
• Coordinators may revoke task completion credit if falsely claimed
• Emergency contact information is only used for urgent campaign matters

5.2 Rally Attendance

• RSVPs are binding commitments to attend events
• Cancellations should be made at least 24 hours in advance
• QR code check-ins verify actual attendance
• Repeated no-shows may affect future participation privileges

5.3 Donations

• All donations are voluntary and non-refundable
• Donations are subject to Kenyan campaign finance laws
• Receipts are provided for all completed donations
• Anonymous donations are accepted and respected

6. CONTENT OWNERSHIP AND LICENSE

6.1 Your Content

You retain ownership of any content you submit to the Platform (stories, photos, videos). However, by submitting content, you grant VAR a worldwide, royalty-free, non-exclusive license to:

• Display your content on the Platform
• Share your content on social media and campaign materials
• Use your content for promotional purposes
• Archive and backup your content

You may request removal of your content at any time by contacting support.

6.2 VAR Content

All Platform content created by VAR (logos, graphics, campaign materials) is owned by VAR and protected by copyright and trademark laws. You may not reproduce or distribute VAR content without permission.

7. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

Key privacy commitments include:

• Your National ID is used only for verification purposes
• Donation information is processed securely by third-party providers
• You can request deletion of your account at any time
• We comply with the Kenya Data Protection Act

8. ACCOUNT TERMINATION

8.1 Termination by You

You may delete your account at any time by:

• Requesting deletion through your portal settings
• Contacting support via email
• Submitting a formal data erasure request

8.2 Termination by VAR

We reserve the right to suspend or terminate accounts that violate these Terms, including:

• Violation of acceptable use policy
• Providing false information
• Attempting to compromise platform security
• Harassing other users or campaign personnel

8.3 Effect of Termination

Upon termination:

• Your account access is immediately revoked
• Your personal data is anonymized within 30 days
• Donation records may be retained for legal compliance
• You may not re-register without prior approval

9. DISCLAIMER OF WARRANTIES

The Platform is provided "as is" and "as available" without warranties of any kind. We do not warrant that:

• The Platform will be uninterrupted, secure, or error-free
• Any errors or defects will be corrected
• The results of using the Platform will meet your expectations
• Campaign outcomes or election results will align with Platform data

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, VAR shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform, including but not limited to:

• Loss of data or information
• Unauthorized access to your account
• Any conduct or content of third parties
• Campaign outcomes or election results

11. INDEMNIFICATION

You agree to indemnify and hold harmless VAR, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your use of the Platform
• Your violation of any third-party rights
• Your content submitted to the Platform

12. MODIFICATIONS TO TERMS

We may modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance. Significant changes will be notified via email or Platform notification.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of Kenyan courts.
